IMPORT AND EXPORT OF GOODS RELATED TO INTELLECTUAL PROPERTY RIGHTS - The customs authority decides to temporarily suspend customs procedures for exported and imported goods when the intellectual property rights holder or legally authorized person makes an application AND PAYS AN ADVANCE OF 20% OF THE SHIPMENT VALUE - based on the provisions at Point b, Clause 1, Article 2 of the Revised Law on Intellectual Property 2022 takes effect from January 1, 2023

PROCEDURES AND DOCUMENTS FOR REQUESTING SUSPENSION OF CUSTOMS PROCEDURES – SUBMIT DOCUMENTS AND DOCUMENTS FOR CREDIT GUARANTEE OF 20% OF SHIPMENT VALUE
ARTICLE 74 CUSTOMS LAW 2014 AND ARTICLE 9 Circular No. 13/2015/TT-BTC dated January 30, 2015
Amended by Clause 7, Article 1 of Circular 13/2020/TT-BTC effective from April 20, 2020

a) Application form; power of attorney document in case of authorization to file an application;

b) Copy of industrial property rights protection certificate

c) Detailed description of goods infringing intellectual property rights,

d) List of legal exporters and importers of goods requiring supervision; list of people capable of exporting and importing goods infringing intellectual property rights.
