Quick answer: From 6 June 2026, certain computers in HS subheadings 8471.30, 8471.41, 8471.49, 8471.50 or 8471.90 require a licence when exported from Vietnam if their description and technical characteristics also match Circular 30/2026/TT-BKHCN. The controlled categories cover computers capable of operating below -45°C or above 85°C; radiation-hardened computers meeting specified thresholds; and computers specially designed to model, simulate or integrate launch-vehicle or sounding-rocket designs when supplied with designated software.

Not every industrial computer, laptop or server under HS 8471 requires a licence. Article 2 of Circular 30 requires a simultaneous match of HS code, goods description and technical characteristics. Storage temperature is not operating temperature, and marketing terms such as “rugged” or “radiation tolerant” do not replace test evidence.

This article concerns exports from Vietnam and reflects Vietnamese law checked through 27 September 2026. It is a translation of the Vietnamese analysis, not advice under United States, Chinese or destination-country law.

1. How Decree 259 and Circular 30 work together

Appendix I to Decree 259/2025/ND-CP places “computers” in the framework list administered by the Ministry of Science and Technology. The licence trigger is narrower. Article 7(3) of Decree 259 and Article 2 of Circular 30 require the goods to match the HS code, description and technical characteristics in the detailed ministerial list at the same time.

Review layerQuestionEvidence
HS codeIs the exported article in 8471.30, .41, .49, .50 or .90?Catalogue, configuration, photographs, block diagram and condition as exported
DescriptionIs it an extended-temperature, radiation-hardened or launch-vehicle-design computer?Product/design specification, qualification report and manufacturer statement
Technical thresholdDoes it cross the precise threshold or software condition?Test method, report revision, model/serial traceability and test conditions
TransactionAre the consignee, end user, end use and location known?End-use statement, contract, screening record and delivery/payment route

Article 4(3) of Decree 259 also creates an end-use/end-user control: where there is information suggesting a WMD use or a designated end user, a licence is required even if the goods are outside the published list.

2. HS 8471 classification boundaries

Circular 30 lists six-digit subheadings. Under Article 2, all Vietnamese eight-digit lines within those six-digit subheadings enter the screening step. The final declaration code must still be established from the goods as exported and the Vietnamese tariff nomenclature.

SubheadingTypical scopeEight-digit lines commonly compared
8471.30Portable ADP machine, not over 10 kg, with CPU, keyboard and display8471.30.20 laptop/notebook/subnotebook; 8471.30.90 other
8471.41CPU, input and output units in the same housing8471.41.10 personal computer; 8471.41.90 other
8471.49Other ADP machines presented as systems8471.49.10 personal computer; 8471.49.90 other
8471.50Processing unit other than 8471.41/.49, possibly containing one or two storage/input/output units8471.50.10 for personal computers; 8471.50.90 other
8471.90Other machines of heading 84.718471.90.10, 8471.90.40 or 8471.90.90 according to function

A measuring instrument, machine controller or telecommunications apparatus does not become heading 84.71 merely because it contains a CPU. Likewise, “server”, “rugged computer”, “mission computer” and “embedded PC” do not determine the subheading. GIR 1, Note 6 to Chapter 84 and GIR 6 must be applied.

Subheadings 8471.60, 8471.70 and 8471.80 are not listed in the three computer entries of Circular 30. The phrase “related equipment” in Decree 259 therefore does not by itself make a keyboard, storage unit or adapter licensable; the detailed list and Article 4(3) end-user control must still be checked.

3. Temperature branch: operation below -45°C or above 85°C

The criterion is the capability to operate in the environment below -45°C or above 85°C. Storage, transport or survival temperature while switched off is not enough. The file should distinguish operating temperature, storage temperature, cold/hot start, derating and workload conditions.

  • The datasheet must match the exact model, suffix and exported configuration.
  • The report should identify chamber temperature, soak time, processing load, power state, cycles and acceptance criteria.
  • A catalogue specifying exactly -45°C or exactly 85°C does not establish “below” or “above”; obtain confirmation of the actual operating range.
  • “-50°C storage” with “-40°C operating” does not meet this temperature criterion.

The 4A001.a.1 note excludes computers specially designed for civil automobile, railway or civil-aircraft applications. The design purpose must be evidenced; installation in a civilian vehicle alone is insufficient.

4. Radiation branch: read the three thresholds precisely

A specially designed radiation-hardened computer is controlled when it meets any of these specifications:

  1. Total Ionizing Dose of at least 5 × 103 Gy (silicon).
  2. Dose-rate upset of at least 5 × 106 Gy (silicon)/second.
  3. Single Event Upset of 1 × 10-8 errors/bit/day.

Do not improvise conversions among rad(Si), Gy(Si), fluence and error rate. Retain the test method, radiation source, bias conditions, temperature, sample size, acceptance criteria and model scope. The 4A001.a.2 note excludes computers specially designed for civil-aircraft applications; the exclusion concerns design, not merely the purchaser's stated use.

5. Modelling, simulation and design integration

Entry 4A102 covers computers specially designed to model, simulate or integrate the design of space launch vehicles specified in 9A004 or sounding rockets specified in 9A104. Circular 30 further states that the entry applies only when the computer is supplied with software specified in 7D103 or 9D103.

A powerful general CAD/CAE workstation is therefore not automatically controlled by this entry. Review the design specification, delivery configuration, licence keys, software list, simulation functions, integration interfaces and end use. GPU performance or a software product name alone is not conclusive.

6. Licensing authority, licence type and dossier

Article 3 of Circular 30 delegates licensing for these Ministry of Science and Technology goods to provincial People's Committees. One dossier may be filed in person, by post or electronically through the National Single Window/local administrative-procedure system.

Under Article 9 of Decree 259, the core dossier includes:

  1. The Appendix III application, one original.
  2. An importer/end-user undertaking, one English original and one Vietnamese translation, both certified by the applicant.
  3. The contract and any competent-authority licence, copies.
  4. The Appendix IV report on transactions under earlier licences, except for a term-licence application.
  5. The Ministry of Industry and Trade confirmation of an Internal Compliance Programme for a term licence.

A shipment licence is valid for three months. A term licence is valid for twelve months without a quantity cap within its scope, but only for a trader with a confirmed Internal Compliance Programme. An incomplete dossier is notified within five working days; the decision to grant or refuse is issued within seven working days after a complete dossier or the relevant inter-agency opinion is received.

7. Customs description and evidence alignment

A description template, to be used only when accurate:

“Automatic data-processing machine in [portable/system/processing-unit] form, model ..., CPU/RAM/storage configuration ..., operating range ...°C to ...°C, [radiation specifications if applicable], intended use ..., manufacturer ..., country of manufacture ..., new, exported from Vietnam, licence no. ... dated ...”

The model, serial number, configuration, operating range, radiation metrics and delivered software must align across the licence, declaration, contract, invoice, packing list, catalogue, test report and end-use statement. 4A001.a.1, 4A001.a.2 and 4A102 are reference control codes, not Vietnamese HS declaration codes.

8. Processing/export-production and customs finalisation

Processing and export-production enterprises should control these goods by model–serial–configuration rather than the generic name “computer”. The same enclosure with a different board, firmware, radiation-hardening treatment or temperature option can have a different control status.

  • Link each BOM/material code to the correct engineering revision and test evidence.
  • Separate production machinery, processing inputs and exported finished goods in inventory records.
  • Trigger a new review for substitutions, board upgrades, firmware changes or added software.
  • Samples, warranty returns and intermediary deliveries still require transaction/end-user screening.

Before the customs finalisation report, reconcile declarations, inventory, BOM, consumption norms, work orders, finished-goods serials and licences. See Dương Minh's customs finalisation review service for processing and export production.

9. Record retention and post-clearance audit

Article 15 of Decree 259 requires licensed traders to keep related records for at least five years and report to the Ministry of Industry and Trade before 30 January each year using Appendix VI. Retain the exact catalogue revision, raw test data, manufacturer confirmations, configuration history, delivered software, end-use statement, licence and delivery proof.

During a post-clearance audit, the licence may be compared with physical serials, ERP records, accounting books, software contracts and delivery documents. See the post-clearance audit preparation workflow.

10. Recommended pre-export workflow

  1. Freeze the model, serial, hardware configuration, firmware and delivered software.
  2. Classify the goods in 8471.30/.41/.49/.50/.90 and the correct eight-digit line.
  3. Test operating—not storage—temperature.
  4. Verify TID, dose-rate upset and SEU against model-specific evidence.
  5. For launch-vehicle use, verify special design and the 7D103/9D103 software condition.
  6. Screen purchaser, consignee, end user, use, location and diversion indicators.
  7. Build the HS–description–technical-threshold–evidence matrix and file with the correct provincial authority.
  8. Align the licence and customs documents before declaration; retain records for at least five years.

12. Frequently asked questions

Does an industrial PC rated -40°C to 85°C require a licence?

Not under the temperature entry alone, because it is neither below -45°C nor above 85°C. The radiation, launch-vehicle and end-user controls must still be reviewed.

Is a -50°C storage rating sufficient?

No. The list tests operating capability, not storage survival.

Is a radiation-hardened computer outside HS 8471 automatically controlled by this entry?

No. Reclassify the actual article, check other list entries and always perform the Article 4(3) end-user/end-use screening.
